Illinois

Illinois has enforced its Artificial Intelligence Video Interview Act (820 ILCS 42) since January 1, 2020. If you ask applicants for Illinois positions to record video and use AI to analyze it, you must notify them, explain how the AI works and what characteristics it evaluates, and obtain consent before analysis.

If an applicant requests deletion, the employer must delete the video and copies within 30 days, then instruct every recipient to delete any copy, including backups. The Act also limits sharing to people whose expertise or technology is needed to evaluate the applicant.

Illinois also expanded AI employment requirements through HB 3773, amending the Illinois Human Rights Act. Effective January 1, 2026, the law prohibits discriminatory use of AI in employment and requires employers to provide notice when using AI for covered employment purposes, including recruitment and hiring. Implementing rules are still being developed.

New York City

New York City’s Local Law 144 regulates automated employment decision tools (AEDTs). Employers and employment agencies generally must ensure a bias audit was conducted within one year before using a covered AEDT, make information about the audit publicly available, and provide required notices.

The DCWP FAQ states that candidates must receive the required notice at least 10 business days before the AEDT is used.

European Union

The EU AI Act classifies certain AI systems used for recruitment and candidate evaluation as high-risk under Annex III. Under the Digital Omnibus on AI (Regulation (EU) 2026/1744, in force since July 27, 2026), the high‑risk obligations for stand‑alone Annex III systems apply from December 2, 2027, and for high‑risk systems embedded in regulated products (Annex I) from August 2, 2028.

Some AI uses are already prohibited. Since February 2, 2025, the AI Act has prohibited AI systems that infer emotions in workplaces and educational institutions, except where the system is intended for medical or safety reasons. This can be relevant to recruitment tools that infer candidates’ emotions from biometric data.
